Trade-In Program (the “Program”) allows you to trade in an old device (phone) that qualifies for a trade/exchange in exchange for a Credit. By participating in the Program, you acknowledge that you understand and agree to these Terms. These Terms and Conditions, as determined by A-1 Wireless Inc. in its sole discretion, including all schedules and exhibits, whether attached hereto or referenced herein, are hereinafter referred to as, this "Agreement".

For the purposes of this Agreement, "Data" means all data, files, software, applications, information, cached data, pictures, music files and other content stored on or otherwise accessible on the Trade-In Device at the time of trade - in and anytime thereafter.

In consideration of credit paid A-1 Wireless Inc. to the customer for the purchase of the Trade-In Device, customer hereby sells, assigns, and transfers all rights, titles, and interests of the Trade-In Device and the Data to A-1 Wireless Inc. as of the date hereof.

• The Trade-In Device must be surrendered at the time of trade-in and will not be returned to the customer under any circumstances.
• The credit paid to customer against trade-in device has no cash value and may not be exchanged for cash and is non-transferrable.
• Customer will not be compensated in any other way for the trade-in amount.
• A-1 Wireless Inc. will accept device battery chargers and accessories however these do not increase the value of your order.
• The prices for trade-in program are based on the information provided by the customer. Prices are subject to re-adjustment/change by A-1 Wireless Inc. in its sole discretion, if there is any difference in condition or functionality of the phone compared to the information provided by the customer.
• The Trade-In Credit may vary depending on the date of the Trade, the Trade- In Device model and condition and other factors and could be even zero.
• The customer is responsible to unlock the Trade-In Device, to remove data, SIM and any accessories, if applicable, and delete all Data from the Trade - In Device before trade-in.
• Customers need to ensure their data and SIM card has been removed from the device, before giving it to A-1 Wireless Inc. Any SIM cards received with customer’s mobile device will not be returned and we will destroy them.
• Customers are responsible for cancelling any network contract linked to each mobile device. A-1 Wireless Inc. is not responsible for any costs associated with the SIM card, arising before, or after, receipt of your mobile device, or arising from any other circumstances whatsoever. The customer will continue to be responsible for such charges.
• A-1 Wireless Inc. accepts no responsibility nor liability for and in relation to the loss, security, protection, confidentiality, or use of customer’s phone data. It is customer’s responsibility to ensure that such data is safely removed or back up has been maintained prior to handing it.
• Customers agree to release A-1 Wireless Inc. from all and any claims, losses, or damages with respect to any data stored, connected to, or contained in the mobile device or on any media used in conjunction with the mobile device in any form.
• Customers agree to provide accurate and current personal information as requested by A-1 Wireless Inc. for sale and trade-in, including but not limited to name, email, A-1 account number and phone number.
• We respect the privacy of our customers. Customers hereby acknowledge that A-1 Wireless Inc. may disclose/use such personal information to our third-party agents and service providers in connection with the Trade-in program. A-1 Wireless Inc. collects this information to:
  • Administer the trade in program,
  • provide improved customer experiences,
  • better market to the customer and other current and potential customers and,
  • verify the information provided by the customer.
• Personal information collected in connection with the Trade may be stored and processed in or outside Canada and may be accessed by the courts, law enforcement and national security authorities of that jurisdiction.
• Customers represent and warrant to A-1 Wireless Inc. that they are the sole owner of the Trade-In Device, free and clear of all liens, claims or encumbrances of any kind.
• Customers must ensure the Trade-In Device can perform all the tasks normally associated with such a device as is in good condition, reasonable wear and tear accepted, which device is associated with a valid Electronic Serial Number (ESN), International Mobile Equipment Identity (IMEI) or Mobile Equipment Identifier (MEID), as the case may be.
• Customers must make certain the Trade-In Device does not contain any content which would infringe upon any existing copyrights, trade secrets or other proprietary rights of third parties; and customer is over the age of majority in your province of residence.

INDEMNIFICATION OF A-1 WIRELESS INC.’s LIABILITY TO THE CUSTOMER AND ANYONE CLAIMING THROUGH THE CUSTOMER PURSUANT TO THIS AGREEMENT AND ANY CLAIM, WHETHER IN WRONGDOING, CONTRACT OR SOME OTHER CAUSE OF ACTION, IS LIMITED TO THE TRADE - IN CREDIT. A-1 WIRELESS INC. SHALL NOT BE LIABLE TO THE CUSTOMER OR ANY OTHER INDIVIDUAL OR ENTITY FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, and conditions are held to be invalid by any law, rule, order, or regulation of any government or by the final determination of any court of competent jurisdiction, such invalidity shall not affect the enforceability of any other provision of these terms and conditions.
